The constitution of the people's republic of China 1982: history of creation, adoption and amendments

Abstract

Since 1949, four Constitutions have been in force in the People's Republic of China: 1954, 1975, 1978 and 1982. The document that became the predecessor of the country's basic law was the “General Program of the Chinese People's Consultative Conference” of 1949. The history of the Constitution is of great interest and demonstrates how carefully the members of the Constitutional Revision Commission treated the meaning of the text of the basic law and how important it was for them to show the continuity, gratitude of generations and provisions enshrined, albeit in not such lengthy acts as the Constitution of the PRC of 1975 and 1978, but fundamental provisions for building a system of “government by law”. In addition, it should be noted that the text of the Constitution of the PRC is being revised and improved taking into account modern trends in both the economy and politics, which can be easily traced in the text of the amendments.
