Implementation of the principles of State sover eignty, territorial integrity and the right to self-determination in relations between the People's Republic of China and Hong Kong

Abstract

The article reveals the actual aspects of the implementation of the principle of self-determination of peoples in connection with the principles of state sovereignty and territorial integrity in the People's Republic of China based on the concept of the special status granted to Hong Kong, Macau and Taiwan. Their status is determined based on the institutional model: “One country, two systems” (OCTS). The systematization of signs of autonomy of territories with a special status is carried out. It is proved that the current system of separation of powers contributes both to the harmonization of relations between the center and the territory, and provokes their confrontation. It is precisely such contradictory relations that are observed today between China and Hong Kong. The article pays special attention to the legal status of Hong Kong and its evolution. The author concludes that it is advisable to pursue a more flexible legal policy of China in the settlement of public relations with Hong Kong.
